Welcome to Good Vibes BC ("Good Vibes BC," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at goodvibesbc.com (the "Site"), including any purchases of products or services made through the Site.

By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases through our Site. By placing an order, you represent that you have the legal capacity to enter into a binding agreement.

2. Products and Services

Good Vibes BC offers apparel, accessories, home décor, gifts, plants, handmade products, embroidery services, and other merchandise.

We reserve the right to modify, discontinue, or limit the availability of any product or service at any time without notice.

All product descriptions, photographs, and pricing are subject to change without notice.

3. Orders

Submission of an order does not constitute acceptance. We reserve the right to accept, reject, limit, or cancel any order for any lawful reason, including but not limited to:

  • Product availability

  • Pricing or typographical errors

  • Suspected fraud or unauthorized transactions

  • Violation of these Terms

  • Orders placed for resale without authorization

If payment has already been processed for a canceled order, we will issue a refund to the original payment method.

4. Pricing

All prices are listed in U.S. Dollars (USD).

Applicable sales tax will be calculated during checkout where required by law.

We reserve the right to correct pricing errors at any time before shipment.

5. Payment

Payment must be successfully authorized before an order is processed.

We reserve the right to refuse or cancel any transaction that cannot be verified or authorized.

6. Custom and Personalized Orders

Personalized and custom-made products, including embroidery services, are manufactured specifically for the customer.

Unless required by law:

  • Custom orders are non-refundable.

  • Custom orders cannot be canceled once production has begun.

  • Customers are solely responsible for confirming spelling, artwork, names, dates, colors, sizing, and design approvals before production.

Good Vibes BC is not responsible for customer-approved errors.

7. Customer-Supplied Materials

Customers submitting logos, artwork, images, or other content represent and warrant that they own or have obtained all necessary rights and permissions.

You agree to indemnify and hold Good Vibes BC harmless from any claims arising from alleged copyright, trademark, or intellectual property infringement resulting from materials you provide.

8. Intellectual Property

All content on the Site, including but not limited to:

  • Logos

  • Product designs

  • Graphics

  • Images

  • Photographs

  • Text

  • Website layout

  • Branding

  • Product descriptions

is owned by or licensed to Good Vibes BC and is protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used without prior written permission.

9. User Conduct

You agree not to:

  • Violate any applicable law.

  • Attempt unauthorized access to the Site or its systems.

  • Upload malicious software or harmful code.

  • Interfere with the operation or security of the Site.

  • Use automated tools to scrape or copy Site content.

  • Misrepresent your identity.

  • Engage in fraudulent or abusive purchasing activity.

Good Vibes BC disclaims all warranties, whether express or implied, including but not limited to:

  • Merchantability

We do not warrant that the Site will operate uninterrupted, error-free, or free from viruses or other harmful components.

13. Limitation of Liability

These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.

Any legal action arising from these Terms shall be brought in the state or federal courts located in Santa Cruz County, California, except where prohibited by applicable law.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Good Vibes BC regarding use of the Site.

19. Changes to These Terms

We may update these Terms from time to time.

Changes become effective immediately upon posting to the Site.

Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
